Founders who receive a Nomor Induk Berusaha, the Business Identification Number issued through Indonesia’s Online Single Submission system, often assume their Business License in Indonesia is complete. For seven specific sectors, that assumption stops the business before it truly starts.

This guide is for founders, foreign investors finishing Company Registration in Indonesia, and operations teams in finance, education, construction, tourism, energy, manufacturing, and e-commerce. It maps exactly which ministry to approach after OSS, in what order, and why the sequence matters.

In practice, the NIB functions as a risk-classification gate, not a finish line. For medium-high and high-risk activities such as peer-to-peer lending or construction, the real approval sits inside a second, sector-specific system that OSS does not fully absorb on its own.

Many businesses discover this gap only when a bank, tender committee, or regulator asks for a document OSS never issued. Business Hub Asia works through this exact sequencing daily, which is often where a Business License in Indonesia project quietly stalls.

How Many Layers does a Business License in Indonesia exactly have?

A Business License in Indonesia is issued in two layers (generally). The first layer is the NIB and its accompanying Sertifikat Standar, generated through OSS under Peraturan Pemerintah No. 28 Tahun 2025 tentang Penyelenggaraan Perizinan Berusaha Berbasis Risiko, the regulation now governing risk-based licensing.

The second layer is Perizinan Berusaha untuk Menunjang Kegiatan Usaha, abbreviated PB UMKU, a set of sector-specific approvals issued by individual ministries. Some PB UMKU items are tracked inside the OSS dashboard, but the actual review and decision still sit with the multiple technical units inside the ministry which require specific local approach. This is where Business Hub Asia comes into play and represent client to obtain PB UMKU.

In short, OSS confirms that a business exists and classifies its risk level. It does not, by itself, authorize lending money, teaching students, building structures, running hotels, installing solar systems for resale, manufacturing goods, or operating an e-commerce platform.

Top 7 Sectors That Need Licenses Outside OSS

The following seven sectors are where Business Hub Asia most often sees Company Registration in Indonesia clients get stuck after OSS. Each section below stands on its own as a quick reference.

1. Financial Services and Peer-to-Peer Lending (OJK)

Financial Services and Peer-to-Peer Lending (OJK)

Fintech lending platforms register an NIB through OSS like any company, but that NIB does not authorize them to lend. Operating as a peer-to-peer lender requires a separate operating license from Otoritas Jasa Keuangan, the Financial Services Authority.

The current legal basis is Peraturan OJK No. 30 Tahun 2024 tentang Layanan Pendanaan Bersama Berbasis Teknologi Informasi, which replaced the older POJK No. 77 Tahun 2016 framework and raised minimum paid-up capital requirements for new entrants.

As of 31 May 2024, OJK reported 100 fintech peer-to-peer lending companies held valid operating licenses, a figure OJK itself publishes to warn the public against unlicensed lenders (source: OJK).

In Business Hub Asia’s experience, the OJK review stage typically includes a readiness check of systems and office infrastructure before a license decision is issued, a step worth planning for as its own consultation rather than a same-day filing.

2. Formal and Non-Formal Education (Kemendikbudristek)

Formal and Non-Formal Education (Kemendikbudristek)

Education is treated differently from most commercial sectors. Surat Edaran Sekjen Kemendikbudristek No. 26 Tahun 2021 states that education is not classified as a business activity under the Job Creation Law, so it does not fully adhere to risk-based OSS licensing.

Pasal 167 of PP No. 28 Tahun 2025 opens a path for parts of the education subsector to be processed through OSS using the risk-based scheme, and makes that scheme mandatory only for formal schools located inside a Special Economic Zone.

Outside that exception, non-formal training providers known as Lembaga Kursus dan Pelatihan need an Izin Operasional from the local Dinas Pendidikan, governed by Permendikbud No. 81 Tahun 2013. Pasal 6 ayat (3) gives the Dinas up to 30 working days to decide.

Once approved, the provider registers for a Nomor Induk Lembaga Kursus with the provincial education office, the national identifier Kemendikbudristek uses to track licensed course and training institutions (source: kursus.kemdikbud.go.id).

3. Construction Services (Kementerian PU)

Construction Services

A construction company obtains its NIB and Sertifikat Standar through OSS, but that Sertifikat Standar cannot be verified until the company also holds a Sertifikat Badan Usaha Jasa Konstruksi, issued outside OSS by an accredited certification body.

Permen PUPR No. 6 Tahun 2025 Pasal 7 ayat (4) now governs risk-based standards for the public works sector, updating the earlier framework set out in Permen PUPR No. 8 Tahun 2022. The SBU itself is issued by a Lembaga Sertifikasi Badan Usaha.

The SBU is valid for five years and confirms the technical competence of the construction business, not just its paperwork. Foreign construction entities operate through a representative office structure known as BUJKA, Badan Usaha Jasa Konstruksi Asing, meaning a foreign construction service business entity.

A BUJKA representative office in Indonesia must independently hold a verified Sertifikat Standar, in addition to its own SBU, before it can bid on or execute construction work inside Indonesian territory.

4. Tourism, Hospitality, and Wellness (Kemenpar)

Tourism, Hospitality

Hotels, spas, salons, and wellness centers register their NIB and Sertifikat Standar through OSS under tourism-risk KBLI codes, but the Sertifikat Usaha Pariwisata itself is issued separately by an accredited Lembaga Sertifikasi Usaha in the tourism sector.

Peraturan Menteri Pariwisata No. 6 Tahun 2025 updated the earlier Permenparekraf No. 4 Tahun 2021, adjusting risk levels and adding new categories of tourism business that now require standardized certification before commercial operation.

Large tourism businesses must obtain their Sertifikat Usaha Pariwisata within two years of receiving their prior registration mark, medium businesses within four years, and micro or small businesses within six years, with the certificate itself valid for three years.

This staggered deadline gives smaller wellness and hospitality operators room to grow into full compliance. As such, Business Hub Asia recommends starting the LSU application early rather than waiting for the deadline year.

5. Energy and Solar Power (Kementerian ESDM)

Energy and Solar Power

Installing rooftop solar panels, Pembangkit Listrik Tenaga Surya Atap, for commercial or industrial use requires a separate approval from the holder of the local electricity distribution license, usually PT PLN, not from OSS.

Peraturan Menteri ESDM No. 2 Tahun 2024 currently governs this process, replacing Permen ESDM No. 26 Tahun 2021. Applications can only be submitted during two annual windows, January or July, under Pasal 14 ayat (2) of the regulation.

Installation must be carried out by a business registered with Kementerian ESDM, and a Sertifikat Laik Operasi from an accredited inspection body is required within one to two months of the technical inspection, per Pasal 23.

Businesses that install panels without this approval risk having their grid connection disconnected by the State Electricity Company until the former comply, a consequence written directly into Pasal 23 ayat (2) and (3) of the regulation.

6. Manufacturing and Software Industry (Kemenperin)

Manufacturing and Software

Businesses in the manufacturing sector must possess  an Izin Usaha Industri  under Undang-Undang No. 3 Tahun 2014 tentang Perindustrian, now issued as a PB UMKU item inside OSS rather than as a fully standalone paper certificate.

Software and application publishers fall under Kemenperin-adjacent KBLI codes but are explicitly exempt from the location permit and environmental permit commitments that apply to physical manufacturers, since they operate without a production facility.

In Business Hub Asia’s experience, this exemption is the detail that most software founders miss. They file the same location and environmental commitments that a factory would, which delays NIB activation for requirements that never applied to them.

Therefore, confirming the correct KBLI classification before filing is the fastest way to avoid this delay, since the classification determines which commitments OSS actually asks the applicant to fulfill.

7. E-Commerce and Trade (Kemendag)

E-Commerce and Trade

Online marketplaces and platforms, classified as Penyelenggara Perdagangan Melalui Sistem Elektronik, need a Surat Izin Usaha Perdagangan Melalui Sistem Elektronik from Kementerian Perdagangan on top of their NIB from OSS.

Peraturan Menteri Perdagangan No. 19 Tahun 2026 replaced Permendag No. 31 Tahun 2023, tightening obligations around local product visibility, platform partnership transparency, and dedicated consumer complaint channels linked to Kemendag’s WhatsApp service.

Currently foreign platforms serving Indonesian consumers must also register, and in some cases must maintain a Kantor Perwakilan Perusahaan Asing, a foreign company representative office, as a contactable entity for consumer disputes inside Indonesia.

Kemendag actively monitors compliance through cyber patrols under its SIMPKTN system (source: Kemendag SIMPKTN), which tracks SIUPMSE ownership and can flag unlicensed platforms and sellers for takedown or further review.

Company Registration in Indonesia vs Sector Licensing: Where Is the Line?

Company Registration in Indonesia and a Business License in Indonesia are two separate legal events. Registration, done through Kemenkumham for a PT or PT PMA, a foreign-owned limited liability company, creates the legal entity itself.

Licensing, whether through OSS or a sector ministry, authorizes that entity to actually perform a regulated activity. A company can be fully and validly registered while still being unauthorized to lend, teach, build, host guests, install energy systems, manufacture, or sell online.

Business Hub Asia typically sequences Company Registration in Indonesia together with sector-specific Business License in Indonesia advisory, since the wrong entity type or KBLI code at registration stage often creates avoidable friction at the licensing stage months later.

What Happens If a Business Skips the Sector License?

  • Fintech lenders operating without an OJK license are prohibited from disbursing or collecting on loans, and OJK actively publishes lists of unlicensed platforms.
  • Banks and tender committees routinely reject vendors during due diligence with incomplete SBU, SIUPMSE, or LSU certificate surfaces.
  • Utilities can disconnect solar installations lacking a Sertifikat Laik Operasi until the owner completes ESDM’s approval process.
  • Kemendag’s cyber patrol system can flag or take down e-commerce listings from platforms that does not possess a valid SIUPMSE.
  • Local Dinas Pendidikan can order unlicensed course providers to close, with sanctions referenced in Undang-Undang No. 20 Tahun 2003 tentang Sistem Pendidikan Nasional.

Getting Every Layer of Approval Right, Not Just the First One

A Business License in Indonesia rarely ends with OSS for these seven sectors. Reaching full operational legality usually means treating the NIB as step one of two, with a ministry-specific approval as the step that actually opens the door to trade.

Business Hub Asia has guided countless founders and foreign investors through consultation or Company Registration in Indonesia and the sector approvals that follow, sector by sector, so a business is not just registered on paper but genuinely cleared to operate.

Frequently Asked Questions

Does every business need a license outside OSS?

No. Most low and medium-low risk businesses only need the NIB and Sertifikat Standar issued directly through OSS under PP No. 28 Tahun 2025. Sector licensing outside OSS applies mainly to higher-risk or specially regulated activities.

What is PB UMKU?

PB UMKU, Perizinan Berusaha untuk Menunjang Kegiatan Usaha, is a category of sector-specific operational approvals issued by individual ministries. Some are tracked through the OSS dashboard, but the review itself is handled by the relevant ministry.

Is the NIB the same as a business license?

Not entirely. The NIB is the Business Identification Number and functions as the base registration and, for low-risk activities, the operating license itself. For higher-risk sectors, it is only the first of several required approvals.

How long does OJK take to review a fintech lending license?

Based on current regulatory practice for fintech lending applications, OJK generally issues an approval or correction request within about 20 days of receiving a complete submission, though document corrections can extend the overall timeline.

Do non-formal education providers need OSS at all?

Yes. Providers of publicly run education still reuire an NIB through OSS before applying for their operational permit from the local Dinas Pendidikan under Permendikbud No. 81 Tahun 2013.

What is a BUJKA in construction licensing?

BUJKA stands for Badan Usaha Jasa Konstruksi Asing, a foreign construction service business entity. It refers to the representative office structure foreign construction companies use to legally operate inside Indonesia.

Do small tourism businesses get more time to certify?

Yes. Micro and small tourism businesses have up to six years from their initial registration mark to obtain a full Sertifikat Usaha Pariwisata, compared to two years for large businesses, under the current Kemenpar framework.

Can a business install solar panels at any time during the year?

No. Under Permen ESDM No. 2 Tahun 2024, applications for rooftop solar installation approval can only be submitted during two windows each year, in January or in July.

Are software companies treated the same as factories under Kemenperin rules?

No. Software and application publishers are exempt from the location permit and environmental permit commitments that apply to physical manufacturers, since they do not operate a production facility.

What license do e-commerce platforms need beyond their NIB?

Platforms classified as PPMSE need a Surat Izin Usaha Perdagangan Melalui Sistem Elektronik, SIUPMSE, from Kementerian Perdagangan under the current Permendag No. 19 Tahun 2026.
