Imagine filing a substantial VAT overpayment claim, only to receive an audit notice months later instead of your expected refund. This guide shows executives of PT PMA companies how to prevent that costly outcome entirely. Read on to evaluate your readiness and protect your bottom line.
Across our work with PT PMA firms, Business Hub Asia (BHA) consistently sees three recurring missteps. Companies rely on outdated decrees, accept modified audit opinions, or assume they are immune from subsequent reviews. Fixing these early ensures your application moves forward without unexpected friction.
Securing Golden Taxpayer Indonesia status, officially known as Wajib Pajak Kriteria Tertentu, changes everything for eligible businesses. It enables qualifying taxpayers to receive preliminary tax refunds following a simple desk review rather than undergoing a painful, full-scale tax audit.
Under PMK 28/2026, decision timelines are remarkably fast. VAT refund decisions arrive within one month, while Income Tax refunds take just three months. This accelerated process provides immediate cash flow relief for foreign-owned firms operating across Indonesia.
The greatest challenge for financial leaders is navigating the regulatory timeline. Every decree granted under the old 2018 rules lapsed on 1 May 2026. With the re-application window closing on 10 June 2026, the next key deadline is 10 January 2027.
Meeting that target requires reverse-engineering your compliance strategy well in advance. Verifying your eligibility now ensures your PT PMA is fully prepared before the next window opens.
What Is Golden Taxpayer Indonesia Status?
Golden Taxpayer Indonesia status is the market name for Wajib Pajak Kriteria Tertentu, a designation the Directorate General of Taxes (DGT) grants under PMK 28/2026. It allows a preliminary refund of overpaid VAT or income tax after a document review rather than a full tax audit.
The term “Golden Taxpayer” does not appear in the regulation itself. It is shorthand for the first of three categories in Article 2 of PMK 28/2026: WP Kriteria Tertentu, Wajib Pajak Persyaratan Tertentu, and low-risk taxable entrepreneurs (PKP Berisiko Rendah).
The Minister of Finance issued the regulation on 29 April 2026. It replaced Minister of Finance Regulation No. 39/PMK.03/2018 and its three amendments, according to the ministry’s legal database.
| Category | Who it covers | Decision window | Overpayment limit | DGT decree needed? |
|---|---|---|---|---|
| WP Kriteria Tertentu (Golden Taxpayer) | Taxpayers with a long, clean compliance record | VAT: 1 month. PPh: 3 months (Art. 7(2)) | None stated in Art. 3 | Yes (Art. 4) |
| WP Persyaratan Tertentu | Smaller corporate taxpayers within set limits | 1 month for corporate PPh and VAT (Art. 11(2)) | Corporate: Rp1 billion, turnover up to Rp50 billion (Art. 9(2)) | No, request made in the return (Art. 10) |
| PKP Berisiko Rendah | Listed VAT entrepreneurs such as listed companies and state-owned enterprises | VAT: 1 month (Art. 17(2)) | None stated | Yes (Art. 14) |
Why Do Tax Refunds Matter So Much for a PT PMA?
Overpaid tax sits with the state while the company still funds payroll, imports, and expansion. The scale is significant. Ministry of Finance data reported by Kontan, an Indonesian business daily, showed refunds of Rp351.05 trillion through November 2025, up 35.5% year on year.
VAT made up about 70% of that total, or Rp247.16 trillion. The same report noted the ministry treats refunds as a taxpayer right guaranteed by law. The pattern fits companies that accumulate input VAT before sales begin.
Common pain points for foreign-owned companies include:
- Input VAT builds up during a construction or pre-revenue phase and traps working capital.
- A standard refund claim can lead to a full tax audit under Article 17B of Law No. 6 of 1983 (UU KUP).
- Audit queries arrive while finance teams are busy with group reporting deadlines.
- Group treasury forecasts become unreliable when refund timing is open-ended.
BHA’s tax team often starts with one question: how much cash is waiting on the tax office, and for how long? That figure usually shows whether the preparation effort is worthwhile, reach out using the contact form below to evaluate your position with our advisors.
What Does PMK 28/2026 Change for Foreign-Owned Companies?
PMK 28/2026 (Minister of Finance Regulation No. 28 of 2026) tightens several points compared with the 2018 regime. It adds a 5% ceiling on audit-based fiscal profit corrections, imposes a five-year service limit on the signing public accountant, and excludes restated financial statements.
- Decrees issued under the 2018 rules ceased to apply on 1 May 2026 (Article 25(a)).
- Holders could re-apply between 1 and 10 June 2026 (Article 25(b)); otherwise the deadline is 10 January (Article 4(1)).
- The DGT can revoke the status for defined failures (Article 5(2)).
- The DGT can cancel an issued refund decision once a preliminary criminal investigation or investigation begins (Article 21).
The DGT’s own published commentary describes the facility as recognition of compliance built consistently over the long term, not a reward for a single good year.
What Is WP Kriteria Tertentu and Which Requirements Apply?
WP Kriteria Tertentu is the legal term behind Golden Taxpayer Indonesia status. Article 3(2) of PMK 28/2026 sets four cumulative criteria. A company must meet all four at the time of determination, and the detail behind each criterion is where most applications fail.
| Criterion | What PMK 28/2026 requires | Common stumbling block |
|---|---|---|
| 1. Timely filing | Annual returns (SPT Tahunan) for the last 3 tax years filed on time. Monthly returns (SPT Masa) for January to November of the last tax year filed, with limited late filing (Art. 3(3)). | Late monthly returns on consecutive periods, or a return filed after the next period’s deadline. |
| 2. No tax arrears | No tax debt past due on 31 December of the last year before determination, unless deferred or in an approved instalment. No late payment in the last 5 years (Art. 3(4)). | One late installment payment. |
| 3. Clean audit history | Audited statements with an unqualified opinion for 3 consecutive years, no fiscal profit correction above 5% from audits in the last 3 years, and an auditor within the 5-year service limit (Art. 3(5)). | An explanatory paragraph or a restated report. |
| 4. No tax crime conviction | No final and binding court conviction for a tax crime in the last 5 years (Art. 3(2)(d)). | Rare, but history must be confirmed. |
Late monthly filing is not automatically fatal. Article 3(3)(c) tolerates delays of no more than three periods per tax type, never consecutive, and never beyond the deadline of the following period. Anything outside that pattern fails the first criterion.
Which Audit Opinions Qualify?
Only a plain unqualified opinion counts. Article 3(5)(b) excludes an unqualified opinion carrying an explanatory paragraph, and Article 3(5)(c) excludes restated statements. Because three consecutive years are required, one disqualifying year effectively restarts the count.
Why Does Auditor Tenure Matter?
Article 3(5)(f) requires the public accountant to respect the five-year limit on audit services, and the taxpayer must submit its own statement confirming this. A global audit network that rotates signing partners on a different cycle can create a gap that surfaces only at application.
BHA’s tax consultants can map each criterion against three years of filings, audit reports, and payment records before any application is filed, so gaps surface while they can still be addressed.

How Fast Is the Tax Refund Indonesia Process Under Golden Taxpayer Status?
Under Article 7(2) of PMK 28/2026, the DGT must issue the preliminary refund decision (SKPPKP) within three months for income tax and one month for VAT, counted from receipt of the request. If the deadline passes, Article 7(3) treats the request as granted.
| Feature | Standard tax refund | Golden Taxpayer preliminary refund |
|---|---|---|
| Type of review | Tax audit under Art. 17B UU KUP | Desk review (penelitian) of the return |
| VAT decision window | Up to 12 months | 1 month (Art. 7(2)(b)) |
| PPh decision window | Up to 12 months | 3 months (Art. 7(2)(a)) |
| Later audit possible? | Not applicable | Yes (Art. 22) |
Article 3 sets no maximum overpayment for WP Kriteria Tertentu. By contrast, Article 9 caps corporate taxpayers in the Persyaratan Tertentu category at Rp1 billion of overpayment. Size alone therefore does not restrict a Golden Taxpayer claim.
Does a Fast-Track Refund Mean No Audit?
No. Article 22 allows the DGT to audit a taxpayer after a preliminary refund and issue an assessment. If an underpayment assessment letter (SKPKB) follows, Article 19(2) applies the administrative sanction in Article 13(2) of UU KUP. The review moves to after payment, not away entirely.
How Does the Review Work Step by Step?
- The company completes the preliminary refund column in its tax return (Article 6(3)).
- The DGT checks formal duties: valid status, filing limits, no tax arrears, audited statements, and no audit of the same period (Article 6(4)).
- The DGT checks calculations, withholding or payment evidence, and creditable input VAT (Article 6(7)).
- For VAT outside the financial year-end month, the DGT also tests a qualifying activity such as exports (Article 6(7)(d)).
- The DGT issues the decision, or notifies that no refund can be given (Article 7(1)).
Step four deserves attention. A company selling only domestically in a given month may struggle to show a qualifying activity for that month’s VAT request. Timing the claim with a consultant avoids avoidable rejection.
How and When Does a PT PMA Apply for Golden Taxpayer Indonesia Status?
| Item | Rule | Source |
|---|---|---|
| Channel | Electronically through the taxpayer portal; in person or by post only if the portal cannot be used | Art. 4(1)-(2) |
| Deadline | No later than 10 January | Art. 4(1) |
| DGT decision | Within 30 working days of receipt | Art. 4(4) |
| If the DGT is silent | Request is treated as granted and the decree must be issued | Art. 4(5) |
| Re-application after revocation | Permitted under the Article 4 process | Art. 5(4) |
Source: PMK 28/2026, Articles 4 and 5, Minister of Finance.
Business planning therefore works backwards from 10 January. A company that wants a decree for the next refund cycle should have its annual return, audit report, and payment history verified well before year end, ideally with professional review.
Where Does Coretax Fit In?
Coretax is the DGT’s core tax administration system, introduced under Minister of Finance Regulation No. 81 of 2024 and operating since January 2025. The refund request is made inside the electronic return, and the application for status goes through the taxpayer portal.
How Long Does WP Kriteria Tertentu Status Last, and What Can Revoke It?
Some market commentary describes the decree as valid for one calendar year. Article 5(1) of PMK 28/2026 instead states it applies from the determination date until the DGT revokes it. The real risk sits in revocation, which Article 5(2) triggers through defined failures.
| Revocation trigger | Detail (Art. 5(2)) |
|---|---|
| Late annual return | Any late SPT Tahunan after determination |
| Late monthly returns | Late for 2 consecutive periods, or for 3 periods in one calendar year, or filed after the next period’s deadline |
| Unpaid tax debt | Debt unpaid at its due date, unless deferral or instalment was approved |
| Late instalment | Late payment under an approved deferral or instalment |
| Audit problems | Unaudited, modified-opinion, or restated statements, an auditor beyond the 5-year limit, unanswered DGT queries, or a fiscal correction above 5% |
| Criminal process | An open preliminary investigation or investigation after determination |

A revoked company may re-apply under Article 5(4), but the 10 January deadline still governs. One missed filing pattern can therefore remove access to fast refunds for many months, which is why monthly calendar discipline protects the benefit.
BHA’s bookkeeping and tax calendar support is built around that discipline: monthly returns, payments, and audit deliverables tracked together so that the status stays intact once granted.
Foreign Company Tax Indonesia: Does Foreign Ownership Change Eligibility?
A PT PMA is a domestic taxpayer and pays corporate income tax at the 22% rate set by Law No. 7 of 2021 on the Harmonization of Tax Regulations (UU HPP). Article 3 of PMK 28/2026 tests the taxpayer’s own record. Foreign shareholding does not appear as a criterion.
Article 1(4) defines a corporate taxpayer broadly, including permanent establishments (BUT, Bentuk Usaha Tetap), so the framework is not limited to PT PMA. Eligibility still depends on meeting every Article 3 criterion, including audited statements.
Foreign-owned companies face practical hurdles. A global audit network may rotate signing partners on a cycle that does not match Article 3(5)(f), and the taxpayer must submit its own statement confirming the audit criteria. Investors still setting up can start with BHA’s overview of PT PMA requirements, or get direct guidance from our team by submitting your inquiry via the contact form below.
Why Does KBLI Alignment Matter for a Golden Taxpayer?
KBLI (Klasifikasi Baku Lapangan Usaha Indonesia, the standard business activity classification) is not a condition in PMK 28/2026. No specific code is required to hold the status, and the regulation contains no KBLI clause. The link is practical rather than legal.
Statistics Indonesia (BPS) issued BPS Regulation No. 7 of 2025 on 18 December 2025, replacing BPS Regulation No. 2 of 2020. BPS states that the OSS (Online Single Submission) and AHU systems were to be adjusted by 18 June 2026 (BPS).
BPS also confirms that licences issued earlier remain valid, with updates required where the scope of business activity changes substantively. Companies should confirm which KBLI 2025 codes correspond to their registered activities.
In our experience, a mismatch between revenue in tax returns and activities registered in OSS invites questions during VAT refund reviews, because Article 6(7)(d) tests whether activities such as exports actually took place. A consultant can reconcile both records before filing.
Tax Consultant Indonesia: When Does a PT PMA Need Professional Support?
PMK 28/2026 does not require a taxpayer to hire an adviser. The risk lies elsewhere: the criteria are cumulative, evidence spans three to five years, and one error can push the next attempt to 10 January of the following year.
A Tax Consultant Indonesia team normally verifies filing dates, payment records, audit opinions, and auditor tenure before an application reaches the DGT. Skipping that review risks an avoidable rejection or a premature revocation.
BHA supports foreign investors with:
- Assessment of the past three years of tax data against Article 3.
- Local bookkeeping aligned with monthly filing and payment deadlines.
- Preparation of systems and documents for the application and later refund claims.
What Do Real-World Golden Taxpayer Cases Look Like?
The three scenarios below are illustrative. Details are simplified, and each rests on the rules of PMK 28/2026.
Case 1: The Manufacturer With an Explanatory Paragraph
A PT PMA producing auto components filed every return on time and carried no tax debt. Its auditor added an explanatory paragraph about a related-party loan in the latest year. The finance team assumed the opinion was clean. Under Article 3(5)(b), it was not, and the three-year count restarted.
Case 2: The Distributor That Missed the June 2026 Window
A foreign-owned distributor held a decree from 2024 and assumed it remained valid. That decree lapsed on 1 May 2026, and no application was filed between 1 and 10 June. A July VAT claim then followed Article 17B audit procedure (Article 19(5)), and the next chance is 10 January 2027.
Case 3: The Exporter That Lost the Status
An exporting PT PMA received VAT refunds quickly. During a system change, three monthly VAT returns were filed late within one calendar year. Article 5(2)(c) allows revocation for exactly that pattern, so the next request returned to the standard audit route.
Turning Overpaid Tax Into Working Capital, With the Right Preparation
Golden Taxpayer Indonesia status rewards companies that treat tax compliance as a long-term discipline. For a PT PMA with VAT or income tax overpayments, the difference between waiting one month and waiting a year can reshape an entire budget.
The path is demanding but achievable. Most obstacles, such as an audit opinion type, a late filing, or a lapsed decree, are visible well in advance. Early review turns them from surprises into manageable tasks.
Business Hub Asia (BHA) supports foreign investors through its Tax Consultant Indonesia service, from reviewing three years of tax data to managing local bookkeeping and preparing systems. That lowers the risk of rejection, revocation, or a missed window.

Talk to an ExpertFrequently Asked Questions
What is Golden Taxpayer status in Indonesia?
Golden Taxpayer Indonesia status is the market name for Wajib Pajak Kriteria Tertentu under PMK 28/2026 (Minister of Finance Regulation No. 28 of 2026). It lets the DGT refund overpaid VAT or income tax after a document review instead of a full audit.
Can a PT PMA qualify for Golden Taxpayer status?
Yes, if the company meets every criterion in Article 3 of PMK 28/2026. The regulation does not treat foreign shareholding as a criterion. It tests the taxpayer’s filing history, tax debt, audited financial statements, and criminal record.
How fast is a Golden Taxpayer tax refund?
Article 7(2) of PMK 28/2026 sets a maximum of one month for VAT and three months for income tax, counted from receipt of the request. If the DGT exceeds the period, Article 7(3) treats the request as granted.
Is there a maximum refund amount?
Article 3 of PMK 28/2026 sets no maximum overpayment for WP Kriteria Tertentu. By contrast, Article 9 limits corporate taxpayers in the Persyaratan Tertentu category to Rp1 billion of overpayment and turnover of up to Rp50 billion.
What are the eligibility requirements?
Article 3(2) sets four cumulative criteria: timely tax returns, no tax arrears, audited statements with an unqualified opinion for three consecutive years, and no final tax-crime conviction in five years. Each criterion carries further conditions.
When is the application deadline?
Article 4(1) of PMK 28/2026 requires applications no later than 10 January, filed electronically through the taxpayer portal. The DGT must decide within 30 working days under Article 4(4), and silence counts as approval under Article 4(5).
How long does the status last?
Under Article 5(1), the decree applies from its issue date until the DGT revokes it. The regulation text sets no one-year term. Revocation follows defined failures in Article 5(2), such as late returns, unpaid tax debt, or a modified audit opinion.
Does the status prevent tax audits?
No. Article 22 of PMK 28/2026 allows the DGT to audit a taxpayer after a preliminary refund and issue an assessment. If an underpayment assessment follows, Article 19(2) applies the sanction in Article 13(2) of Law No. 6 of 1983 (UU KUP).
Does a KBLI code affect eligibility?
PMK 28/2026 contains no KBLI condition. BPS Regulation No. 7 of 2025 introduced KBLI 2025, and OSS data should match actual activities, because VAT refund reviews under Article 6(7)(d) test whether qualifying activities such as exports occurred.
Can a company that lost the status apply again?
Yes. Article 5(4) of PMK 28/2026 allows re-application under Article 4, so the 10 January deadline still applies. A tax consultant can review the revocation cause and the company’s records before a new application is prepared.
