Important Consideration
- Trademark registration is “first to file” – whoever registers first will have exclusive rights to the mark.
- One trademark can be registered for more than one class of products/services.
- Registered trademarks will get legal protection for 10 years and can be extended.
- The brand design must be original and not imitate other registered brands to avoid rejection.
Frequently Asked Questions
Can I register my brand before producing my product?
Yes, you can. Registration should be done before the product is in circulation to avoid claims from other parties.
What cannot be registered as a trademark?
Common names, country symbols, or marks that resemble other registered marks are not acceptable.
What is a brand classification, and how to choose one?
A trademark classification (Nice Classification) categorizes types of goods/services. We help you determine which classification suits your business.
Does a trademark registration apply internationally?
Trademarks registered in Indonesia are not automatically valid internationally. Protection is limited to Indonesian territory. For international trademark protection, application through the Madrid Protocol is necessary.
What if my trademark is refused?
We will help analyze the reasons for refusal and prepare a response document or brand revision.
How long is the validity period of a trademark certificate?
A trademark certificate is valid for 10 years and can be renewed for another 10 years periodically.
